Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and GoFindStuff LLC (an Illinois limited liability company, “GoFindStuff,” “we,” “us”) and govern your access to and use of the GoFindStuff application at app.gofindstuff.comand any related services (collectively, the “Service”). By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

Section “Dispute resolution” contains an arbitration agreement and class-action waiver that affect your legal rights. Read it carefully.

• You must be at least 18 years old to create an account.
• You must have the legal capacity to enter into this contract.
• You must not be barred from using the Service under the laws of the United States or any other applicable jurisdiction.
• If you are using the Service on behalf of a household or organization, you represent that you are authorized to bind it to these Terms.

• You're responsible for everything that happens under your account.
• Don't share your password. One human per account.
• Tell us promptly if you suspect unauthorized access — email legal@gofindstuff.com.
• We may suspend or terminate accounts that violate these Terms (see “Termination” below).
• We may require you to re-accept these Terms when we make material changes.

You retain full ownership of every photo, video, item description, listing, and message you submit (“User Content”).

You grant GoFindStuff a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, create derivative works from (e.g., generating thumbnails or AI-derived inventory), publicly display, and publicly perform your User Content solely as necessary to operate, provide, and improve the Service. This license ends when you delete your User Content or close your account, except for (i) back-up copies retained for the period described in our Privacy Policy, and (ii) content you have shared with other users that they have not deleted.

You represent and warrant that you own or have the necessary rights to your User Content and that uploading it does not infringe any third party's rights or violate any law.

When using the Service you agree not to:

• List items you do not own or have the right to sell.
• List items prohibited under our Acceptable Use Policy (illegal items, weapons, controlled substances, stolen goods, recalled products, hazardous materials, counterfeit items, and others as listed there).
• Misrepresent the condition, authenticity, or ownership of any item.
• Use the Service to harass, threaten, defraud, or impersonate any person, including other users.
• Attempt to reverse-engineer the AI pipeline, scrape the marketplace, circumvent rate limits, or otherwise interfere with the Service.
• Upload malicious code, attempt to gain unauthorized access, or probe for vulnerabilities outside any public bug-bounty program we may run.
• Violate our Community Guidelines.

We may remove content or suspend accounts that violate these rules. We'll tell you why, except where prohibited by law.

The GoFindStuff marketplace lets you list items for sale to other users within a chosen geographic radius and exchange messages with interested buyers. GoFindStuff is a platform, not a party to any transaction. We do not own, sell, resell, furnish, deliver, or hold title to any items listed by users. All transactions take place directly between the buyer and the seller.

• We make no warranty as to the accuracy of any listing, the condition of any item, or the conduct of any user.
• We are not responsible for payment between buyers and sellers, for any failure to deliver an item, or for any item that turns out to be counterfeit, defective, or misrepresented.
• You are responsible for your own compliance with applicable tax, consumer-protection, product-safety, and resale laws — including reporting any income from sales.
• You agree to use common sense when meeting other users in person (see “In-person meetups” below).

Some features may surface in-person meetups (for example, picking up an item you purchased) or community garage-event features that allow users to coordinate sales in the physical world. GoFindStuff does not screen users, vet venues, or supervise these meetings. You participate at your own risk.

• Meet in public places whenever possible. Many police departments offer designated safe-exchange zones.
• Bring a friend. Tell someone where you're going.
• Do not carry weapons or otherwise create unsafe conditions.
• Do not exchange any items prohibited by our Acceptable Use Policy.

To the fullest extent permitted by law, you release GoFindStuff and its affiliates, officers, employees, and agents from any and all claims, demands, damages, costs, and liabilities arising out of or relating to any in-person meeting or event coordinated through the Service.

The Service includes AI-generated resale ranges, item identifications, depreciation forecasts, and chat assistance. These are produced by machine-learning models using publicly observable marketplace data and are not a guarantee of sale, appraisal, valuation, or fitness for any purpose. Final pricing and transaction terms are between you and the counterparty. We do not warrant that any item will sell at any particular price, or at all.

• The free tier remains available while we finalize paid plans. We will announce final pricing and email every active account at least 14 days before any billing begins.
• You may cancel any paid subscription at any time from Settings. Cancellations take effect at the end of the current billing period; we do not pro-rate refunds for partial periods except where required by law.
• If you believe we have charged you in error, email hello@gofindstuff.com within 30 days and we will investigate.

The Service, including the software, design, brand, logos, AI models, and original copy, is owned by GoFindStuff LLC or its licensors and is protected by US and foreign intellectual property laws. We grant you a personal, non-transferable, non-exclusive, revocable license to access and use the Service for its intended purpose. All other rights are reserved.

“GoFindStuff” and the GoFindStuff logo are trademarks of GoFindStuff LLC. You may not use them without our prior written permission.

We respect copyright. If you believe content on the Service infringes your copyright, follow the procedure described in our DMCA Policy and send a complete notice to dmca@gofindstuff.com. We will respond to valid notices and may terminate the accounts of repeat infringers.

The Service may link to or interoperate with third-party services (payment processors, mapping providers, etc.). We don't control those services and are not responsible for them. Your use of them is governed by their own terms and policies.

You can close your account at any time from Settings → Privacy → Delete account, or by emailing hello@gofindstuff.com. We may suspend or terminate your access to the Service if you violate these Terms, if we are required to by law, or if continuing to serve you would expose us to material legal or commercial risk.

On termination, the licenses we grant you end immediately. Sections intended to survive termination (including “Your content” licenses already exercised, “Intellectual property,” “Disclaimers,” “Limitation of liability,” “Indemnification,” “Dispute resolution,” and this section) will survive.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, GOFINDSTUFF DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED ESTIMATES, ITEM IDENTIFICATIONS, OR LISTINGS WILL BE ACCURATE.

TO THE FULLEST EXTENT PERMITTED BY LAW, GOFINDSTUFF AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

You agree to indemnify and hold harmless GoFindStuff LLCand its affiliates, officers, employees, and agents from any claim, loss, liability, demand, damages, costs, or expenses (including reasonable attorneys' fees) arising out of or related to (a) your User Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any law or third-party right.

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Subject to the “Dispute resolution” section below, the state and federal courts located in DuPage County, Illinois will have exclusive jurisdiction over any dispute that is not subject to arbitration.

We hope you never have a dispute with us. If you do, please email legal@gofindstuff.comfirst and we'll try to resolve it informally within 60 days.

If we can't resolve a dispute informally, you and GoFindStuff agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will take place in DuPage County, Illinois (or by telephone or videoconference, at your election) and be conducted in English.

Class-action waiver. You and GoFindStuff agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative action. The arbitrator may not consolidate or join claims of more than one person.

Exceptions. Either party may bring an individual action in small-claims court, and either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual-property rights.

Right to opt out. You can opt out of this arbitration agreement by emailing legal@gofindstuff.com within 30 days of first accepting these Terms with the subject “Arbitration Opt-Out.”

We may update these Terms occasionally. If we make material changes, we update the policy version at the top of this page and re-prompt active users to accept the new version on next sign-in. Continued use of the Service after the effective date means you accept the updated Terms.
